Durafy's Concrete FlatWork Limited Warranty Terms & Conditions

1. Warranty Framework

Durafy provides a limited workmanship warranty for concrete flatwork installations based on the scope selected and the conditions under which the work is performed.

Warranty coverage shall be as follows:

  • One (1) Year Limited Warranty – Applies when the client accepts Durafy’s full recommended installation scope
  • Six (6) Month Limited Warranty – Applies when the client elects to modify, reduce, or decline portions of the recommended scope
  • Three (3) Year Limited Warranty – Applies only to qualifying reinforced installations as defined in Section 10
  • No Warranty – Applies where the client directs Durafy to proceed under conditions or methods that deviate from professional recommendations, as defined in Section 4

All warranties apply from the date of substantial completion.

2. Scope of Warranty

This warranty applies solely to defects in workmanship directly attributable to Durafy’s installation.

Durafy’s responsibility is limited to defects that:

  • Materially affect the structural integrity, or
  • Prevent the concrete from performing its intended function

This warranty does not cover all conditions affecting concrete performance.

3. Construction Standards & Scope Acceptance

Durafy performs all work in accordance with accepted industry practices, including:

  • Minimum 3500 PSI concrete mix (unless otherwise specified)
  • Reinforcement using wire mesh and/or rebar as applicable
  • Proper placement, grading, and compaction to the extent conditions are visible and reasonably verifiable
  • Industry-standard placement, finishing, and curing methods

Durafy does not warrant unknown or concealed subgrade conditions, soil stability, drainage conditions, or environmental factors beyond its control.

Full warranty coverage is expressly conditioned upon the client’s acceptance and purchase of Durafy’s recommended installation scope, including:

  • Grading
  • Subgrade preparation
  • Soil compaction
  • Reinforcement as specified

If the client elects to modify or decline any portion of the recommended scope:

  • Durafy shall not be responsible for resulting performance issues
  • The applicable warranty shall be limited to six (6) months

4. Right to Decline Warranty (Non-Conforming Conditions)

Durafy reserves the right to decline all warranty coverage where work is performed under conditions or directives that deviate from professional recommendations.

This includes, but is not limited to:

  • Proceeding under unsuitable weather or site conditions
  • Client-directed deviations from recommended installation methods
  • Inadequate or unstable site conditions
  • Refusal of necessary preparation, grading, or reinforcement

In such cases:

  • Work may proceed only upon client acknowledgment and authorization
  • The work shall be considered non-warrantable
  • No warranty (express or implied) shall apply

The absence of warranty in these situations reflects accepted risk conditions, not defective workmanship.

5. Definition of Warrantable Defects

Warrantable defects are limited to:

  • Significant structural cracking caused by improper installation
  • Failure of the slab attributable to workmanship
  • Improper placement or finishing resulting in functional failure

All determinations shall be made solely by Durafy based on industry standards.

6. Non-Warrantable Conditions (Exclusions)

The following are not defects and are excluded:

A. Natural Concrete Behavior

  • Hairline cracking
  • Shrinkage or thermal cracking
  • Control joint cracking

B. Soil & Subgrade Conditions

  • Settlement or movement
  • Drainage issues or erosion

C. Environmental Factors

  • Freeze/thaw cycles
  • Weather exposure (rain, snow, ice, heat)
  • Curing variations

D. Aesthetic Variations

  • Color differences
  • Efflorescence
  • Surface texture variations

E. Usage Conditions

  • Overloading beyond intended design
  • Impact damage or misuse
  • Chemical exposure (including salts)

F. External Causes

  • Modifications by others
  • Landscaping or utility work
  • Irrigation or water-related issues

7. Client Responsibilities

The client agrees to:

  • Allow proper curing time before use
  • Avoid excessive loads
  • Maintain proper drainage
  • Follow all maintenance recommendations
  • Avoid harmful chemicals or misuse

Failure to comply voids this warranty.

8. Environmental & Cold Weather Acknowledgment

Concrete performance is affected by environmental conditions.

The client acknowledges that:

  • Weather conditions impact curing and performance
  • Variations caused by environmental conditions are not defects
  • Uniform appearance cannot be guaranteed under variable conditions

9. Warranty Claim Procedure

To initiate a claim:

  1. Provide written notice within the warranty period
  2. Allow access for inspection
  3. Do not alter the affected area prior to inspection

Durafy retains the sole right to determine:

  • Whether a defect exists
  • The appropriate corrective action

10. Optional Extended Warranty (3-Year – Reinforced Flatwork Only)

A three (3) year limited warranty may apply if all conditions are met:

Eligibility:

  • Minimum 4000 PSI concrete
  • #4 rebar or greater
  • Reinforcement spacing at 12 inches on center or less
  • Proper reinforcement placement

Must be explicitly stated in writing in the agreement or invoice.

Scope:

  • Extends duration only
  • Does not expand defect definition

Limitations:

  • No guarantee of crack-free performance
  • No guarantee of uniform appearance
  • Subject to all exclusions in this agreement

Void Conditions:

  • Drainage changes
  • Overloading
  • Modifications by others
  • Lack of maintenance

11. Remedy & Limitation of Liability

Durafy’s obligation is limited to:

  • Repair, or
  • Replacement of affected areas at Durafy’s sole discretion.

Durafy does not guarantee matching color or texture.

To the fullest extent permitted by law:

  • This warranty is exclusive
  • No liability for incidental or consequential damages
  • Total liability shall not exceed the contract value of the work performed

12. Transferability

This warranty is non-transferable unless agreed in writing.
